Terms of Service
1. Acceptance of Terms
By accessing or using the LoungeOps platform ("Service") operated by LoungeOps LLC ("LoungeOps," "we," "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of Service
LoungeOps is a cloud-based operations management platform designed for airport lounge operations. The Service includes incident reporting, facilities management, staff scheduling, compliance tracking, shift reporting, and related operational tools.
3. Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized access.
Organization administrators are responsible for managing user access and permissions within their organization.
4. Free Pilot Program
New accounts receive a 90-day free pilot with full access to all platform features. At the end of the pilot period, continued access requires a paid subscription. We will notify you before your pilot expires. No credit card is required to start a pilot.
5. Subscription and Billing
Paid subscriptions are billed monthly at the rate in effect at the time of purchase. Prices may change with 30 days' written notice. All fees are non-refundable except as required by law. Enterprise customers operate under separate agreements.
6. Your Data
You retain ownership of all data you enter into LoungeOps ("Customer Data"). We do not claim ownership of your Customer Data. You grant us a limited license to host, store, and process your Customer Data solely to provide the Service.
You are responsible for the accuracy and legality of Customer Data. You must ensure you have the right to enter any personal information about your staff or third parties.
7. Data Export and Portability
You may request an export of your Customer Data at any time by contacting us. Upon account termination, we will make your data available for export for 30 days before deletion.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or its infrastructure
- Reverse engineer, decompile, or disassemble the Service
- Share account credentials with unauthorized parties
- Use the Service to store or transmit malicious code
9. Availability and Support
We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance that temporarily affects availability. Standard plan customers receive email support. Enterprise customers receive support under their separate agreement.
10. Intellectual Property
The Service, including its design, code, features, and documentation, is owned by LoungeOps LLC and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.
11. Limitation of Liability
To the maximum extent permitted by law, LoungeOps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.
Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.
LoungeOps is an operational management tool, not a substitute for professional legal, safety, or regulatory compliance advice.
13. Termination
You may cancel your account at any time by contacting us. We may terminate or suspend your access if you violate these Terms or for any other reason with 30 days' notice. Upon termination, your right to use the Service ceases immediately, subject to the data export period described in Section 7.
14. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in New York County, New York.
15. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Continued use after changes constitutes acceptance.
